Contract for Family Genealogy CD Services - Revision #12

This is a contract between ___________________________________ (buyer) who resides at __________________________________________________________ (address+zip) and Paul E. McFerrin (seller) to produce one (1) copy of a Family Genealogy CD. Buyer recognizes that this is a cooperative effort and is required to provide the seller with a data CD containing Genealogical data, pictures (optional), and audio clips (optional). The end product will be the delivery of a auto-runable Family Genealogy CD (product) that will contain the Genealogical data, audio clips (optional), and photographic images (optional). All data will be viewable using a user provided PC with either Netscape or Internet Explorer browser installed. The end user will be responsible for installing a MP3 player if they do not have one installed and desire to listen to optional audio clips. The Family Genealogy CD will only work on a Microsoft's Windows PC platform. Specifically, MacIntosh platforms can not support the long filenames created on the CD.
The cost for this service will be a total of (circle one) $99.95 (USD) or ________ (auction price). Seller has the right to refuse or accept this contract with such notice delivered to ____________________________________ (buyer's email address). When seller accepts this contract, buyer shall be given the option to acknowledge or reject the terms or price of this contract. If accepted, the work will commence after seller receives a data CD from the buyer containing images, audio clips (optional), or Genealogical data (GEDCOM file).
Buyer further agrees that he/she has the legal right to use the Genealogical data and photographs in a Family Genealogy CD and will hold the seller harmless in any legal actions with respect to the product. Seller agrees that Genealogy data supplied by buyer will only be used to produce the Family Genealogy CD and will not be sold or made available to anyone else except for this purpose. At the conclussion of this project, the original data CD and the Family Genealogy CD will be delivered to the buyer upon which all data will be deleted from the sellers PC hard drive
Buyer agrees to obey the guidelines established for creating the original data CD. These guidelines ensure a smooth operation in the production of the Family Genealogy CD. Buyer will also be responsible for any edit operations of the photographs. This includes cropping, brightness/contrast adjustment, and sharpening of the photographs. The seller will make no changes to the photographs nor the Genealogical data except to generate Genealogy reports for the Family Genealogy CD.
Payment of all fees due are in US dollars and can be made via cashier check, certified check, money order, or major credit card. Credit card transaction will be handled thru an independant paying service at http://www.paypal.com/. This site is operated by eBay and accepts Visa, MasterCard, or transfers from your bank account. Delivery of the product will be made after final payment is received. Buyer will be given the opportunity to pre-view the Family Genealogy CD data from the seller's web site at buyer's request before CD is created and final payment due.GUIDELINES
All scanned images are to be organized into folders under the main folder named \images. The folder heirarchy should represent your genealogical generations with your oldest generation(s) up at the higher levels. Each folder should contain the following kinds of files:
Each folder under the \images folder may contain one special sub-folder named \kids. This folder is optional and can be used to hold photos of the children of the persons the folder represents. This is usefull if the child did not marry and has no children of its own.
- file called __name__ which contains lines of text that identifies the contents of this folder. This text will appear as a title for the generated index page for that folder and the folder title page for the slideshow. An example of this line might be: Family of Charles Otis & Mary Alice McFerrin This is a required file for every folder.
- Multiple image files with the .jpg or .png file type extension. The name may consist of any valid Windows filename with the exception of: imbedded spaces or the "&" charcter. You may use characters such as "_" to provide readability separation and the "+" characers where you might be tempted to use the "&" character. Filenames beginning with "tn_" prefix are reserved for thumbnail images created by me in the creation process. My tools can accomodate either .jpg or .png images but not both.
- For every .jpg file (or .png), there should be a corresponding .txt file to contain the associated text that describes the photo. This text will appear on the left 20% of the screen when the picture is displayed. The filename portion must match exactly the filename portion of the .jpg or .png file. The filename portion is case sensitive. You can use any text editor or most Word Processing program to create the .txt files. The underlying operating system used in the CD creation process can not distinguish the difference between same filenames using different cases. e.g. Don't create files called paulm.jpg and PaulM.jpg. This will only confuse the tools and they treat the two files as one single file. The file type portion of the filename (e.g. .txt, .jpg, .png) must all be lower case.
- Good results are obtained when the image is scanned at 300 dots per inch. If the scanned image is larger than 3.0 inches in any direction, the size of the image should be reduced (preserving same aspect ratio) to about 3.0 inches. You should not enlarge the image as image enlargement is automatically performed by the browser. The large images causes delays in displaying the photograph as the data must be read from the CD. Limiting the size to 3.0 inches both maintain reasonable load times and still have enought resolution for a family member to generate a 5x7 print of the image. Something to consider. Many of the image editor tools provide some manor to perform this reduction in size. Some are just easier to do than others.
- Parallel to the \images folder is an optional folder named \docs. This folder will hold images of artifacts. There are usually many types of artifacts that are of poor quality that they need to be displayed at their full size to be readable using scroll bars. Again these images need to be in a .jpg or .png format. If you provide an associated .txt file, I will attempt to identify all of your files in this folder in a table format with clickable links to view. Example of artifacts may include such items as birth, death, marriager records, obituaries, and newspaper clippings.
Seller reserve the right to change the names of files and/or folder in order conform to maximum filename length imposed by the ISO 9660 CD standard with Joilet extensions. Without this renaming, it is possible that some of the generated file names for the slideshow portion of the CD will be too long. Try to avoid using very long file names. Long file names can cause the 20% width column reserved for text to go way beyond the 20% design limit. E.G.: instead of using "Paul_McFerrin_and_his_marriage_to_his_first_wife_Saddie.jpg", use something like "Paul01.jpg" and supply the full detains in the .txt file.
By following the above guidelines, you enable a smooth process of generating your product at the same time provide a higher quality product. Depending upon the amount of time you wish to dedicate to photo scanning and the software available to you, you may or may not want to perform photo touch up. Touch ups can be perform to minimize the impacts of cirgarette burns and photo cracking, something that can be common with heirloom pictures. It's your product and effort so it's your decission.
LIMITATIONS.... The total size of the completed Family Genealogy CD is limited to 650MB (74 min -R media). The final product will contain the data that you originally provided to me plus the following allowances:
The above sizes are typical averages. Your CD could be higher or lower.
- Allow 15KB for each .jpg or .png image file for the creation of the slideshow folder and thumbnail images.
- Allow 200KB for genealogy reports for each person that is requested.
- Allow 150KB for each person in your family tree for the creation of the Family Sheet pages.
